Park Beach Systems Subscription Services
Park Beach Systems, Inc. (PBS) provides software and support subscription services under the GNU/GPL 2 licence. All use thereof is subject to the terms of this licence.
Although every reasonable effort is made to ensure that software functions as expected, the software are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use the products.
No guarantee is made that our software will function correctly with, not conflict with, or be compatible with any other 3rd party software.
The purchase of subscription services does not constitute the purchase of any individual software item, but is a purchase of the right to access a particular part or parts of the PBS website for the lifetime of the subscription, as well as any other subscription benefits as may be granted from time to time.
Activation of the subscription completes the purchase of the subscription and grants immediate access to all subscription benefits. Where this includes access to downloadable files activation and grant of access will constitute delivery of these files.
Support services are provided to qualifying paid subscribers only and only if they are logged in. Likewise to our download services, support services are provided only for the term of your paid subscription through our forum area. When your paid subscription expires you will not be able to access your existing forum posts or submit new posts.
Our services are provided as-is, without any warranty whatsoever. Regarding the support services, we can not guarantee the validity or veracity of any provided information or suggestion.
THE SERVICES ARE PROVIDED AS-IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE AVAILABILITY, QUALITY AND PERFORMANCE OF OUR SERVICES IS WITH YOU. SHOULD ANY OF OUR SERVICES PROVE INEFFICIENT OR UNSUITABLE, YOU ASSUME THE COST OF ALL NECESSARY ACTIONS TO RECTIFY THE ISSUE.
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW PARK BEACH SYSTEMS, INC, ITS OWNERS, STAFF, ASSOCIATES OR ANYONE AFFILIATED WITH ITS MAINTENANCE, OPERATION OR HOSTING BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF OUR PROGRAMS TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
If you do not agree with these Terms, you are not allowed to use our services. Moreover, any use of our services implies the unconditional and immediate acceptance of the aforementioned terms, waiving your legal rights to uphold them. Acting in violation of these Terms of Service constitutes a violation of our copyright and abuse of a computer system, both persecutable as felonies.
Refunds will only be granted under the following conditions:
- If the purchaser submits duplicate purchases in error, the duplicate transaction will be refunded
- If issues with the software results in the inability to use the software or a feature of the software cannot be resolved with direct or indirect support (available documentation, forum and other support articles) or incidental patches and official updates to the software, and where such issues are not the result of incorrect use by the user, a server or conflict with 3rd party software.
We only provide support to our paid subscribers through our site's forum area. We will not provide support by any other means including, but not limited to, email, regular mail, telephone, Twitter, Facebook, or other social media. If you wish to receive support without using our site's forum area or demand that you be given a full discount in violation of our refund policy we reserve the right to request to be paid according to our regular consultancy rates. Our regular consultancy rates are $80 USD, minimum charge one hour.
Subscriptions from PBS are not to be considered as a gurantee of response time or a service level agreement. All support questions are answered on a "best effort" basis. Severe bug reports are given top priority, and forum posts are given medium priority. If you have not received any response withing 72 business hours, please use the Contact Us page to let us know of the issue. If we determine that there is an objective difficulty in providing support to you over our forum system we will provide you with support over email, in exception of our support policy.
We reserve the right to provide no support for outdated versions of our software or when your server environment does not meet our minimum requirements. Support policy details regarding different versions of our software and server environment are detailed in our release announcements. We will not provide support for issues not related to our software or services. We reserve the right to decline support if the request or the conversation is conducted in a language other than English or when the language barrier makes it impossible to provide meaningful support. We reserve the right to decline support when access to the affected site is denied or objectively impossible. We reserve the right to decline providing support on a case by case basis (even though we do try to help everyone), with or without a reply to your forum post. We reserve the right to edit or delete forum posts or replies. We reserve the right to block accounts of users who become abusive and/or pugnacious in their forum area.
Updates to our Terms of Service
